The petitioner is apprehending his arrest in connection with Jama PS Case No.44 of 2025, for offence registered under section 274,275,292, 319(2),318(4),338, 336(3),BNS, 2023, Section 47 (a)(b)(c), 52(d) and 55 of Excise Act, pending in court of learned Judicial Magistrate, 1st Class, Dumka. 3. Learned counsel for petitioner submits that foreign liquor was recovered from one Bolero and two motorcycles. He further submits that the petitioner has nothing to do with the said Bolero vehicle and the two motorcycles and the petitioner has got no criminal antecedent as disclosed in paragraph no.14. He next submits that name of the petitioner has been inserted in the FIR only alleging that the persons who were fleeing away from the spot were uttering the name of the petitioner. 4. Learned State counsel opposes prayer and submits that the foreign liquor was illegally being carried on the vehicle in question. 5. Considering that petitioner is neither the owner nor the driver of vehicle in question and foreign liquor was recovered from Bolero vehicle and 2025:JHHC:35188 2 A.B.A. No.6623 of 2025 two motorcycles and only on the allegation of uttering the name of the petitioner by persons who were fleeing away from the spot the petitioner has been implicated and petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Magistrate, First Class, Dumka, in connection with Jama PS Case No.44 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
