The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.514/2024 registered at Police Station Mundawar, District Khairthal-Tijara for the offences under Sections 103(1), 351(3) & 3(5) of BNS. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Learned counsel submits that the allegation of causing fatal injury on the person of deceased is against co-accused Dayaram. It is submitted that it is alleged in the FIR that petitioner caught hold the deceased and co-accused Dayaram caused injury on the neck (near ear) of deceased by axe (kulhadi). Learned counsel contends that petitioner is in custody since 07.10.2024. Further custody of the petitioner would not serve any fruitful purpose. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by the learned counsel for the petitioner. Learned counsel for the complainant submits that there is specific allegation against the petitioner that he caught hold the deceased and co-accused Dayaram caused injuries on the neck of the deceased. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, as also the fact that petitioner is female; she is in custody since 07.10.2024; charge-sheet has been filed and trial will take time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6.
