ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
Order dated 06.11.2024 granting ad interim relief to the petitioner directing the respondent to redeliver the physical possession of the property, read with order dated 30.08.2024 extending the said interim order, are made subject matter of the contempt jurisdiction of this court under the Contempt of Courts Act, 1971. The said interim orders are passed in pending Writ Petition No.23882 of 2024.
2. Admittedly, the orders are interim orders whereby ad interim relief is granted, date is fixed for listing of the matter and the petition is pending. This position could not be disputed by learned advocate Mr..Bharath B. Yadav for learned advocate Mr..H.M..Muralidhar for the complainants.
3. When the orders are interim in nature and the parent proceedings of the writ petition are pending before learned Single Judge, all contentions of the parties are open at large before

learned Single Judge including the complaint about non- compliance.
4. When the rights are not crystallized finally, this Court is not inclined to invoke the contempt jurisdiction leaving it open for the complainants to work out their rights and remedies in the proceedings of writ petition.
5. Without going into any aspect of merit, the contempt petition is not entertained on the sole ground as above.
