ORDER IN CIVIL APPLICATION: This is an application for bringing legal heirs of petitioner on the record of the main petition. Considering the averments made in the application,
submissions canvassed by the learned advocates and considering the scope of Article 226 of the Constitution of India as well as the principles of Order XXII of the Code of Civil Procedure, 1908, this application is required to be allowed. Accordingly, allowed. Delay, if any, is condoned. Legal heirs are permitted to be brought on record. Necessary amendment be carried out forthwith.

ORDER IN SPECIAL CIVIL APPLICATION: This petition is filed for the following prayers:
“21(A) Quashing and setting aside the order dt. 7.6.2005 (Annexure G) and order dt.7.7.2007 (Annexure I) and to refund the amount already deducted from the salary of the petitioner and to treat the period of suspension from 13.12.2001 to 3.8.2005 as spent on duty for all purposes and to pay the resultant amount with 10% interest. (B) During the pendency and final disposal of this petition, the Respondent may be directed to treat the period of suspension i.e. 13.12.2001 to 3.8.2005 as on duty and to fix the pay of the petitioner on that basis. (C) xxxx” Heard learned advocates for the parties. Considering the issue involved in the petition, the prayers prayed for, as the petition is pending since 2007 without interim relief being granted, with the afflux of time, the petition has become infructuous. Accordingly, disposed of as having become infructuous. Notice/rule, if any, is discharged. Interim relief, if any, stands vacated.
