JOSHI, J. DATE : 18TH AUGUST, 2026. ORDER : . Applicants seek pre-arrest bail in connection with Cr. No. 695/2024 registered with Shirdi police station Tq. Rahata, for the offences punishable U/Sec. 109, 189(1), 189(2), 190, 191(1), 191(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. First information report lodged on 19th December, 2025 indicates occurrence of incident of 06th July, 2024 in which 2026:BHC-AUG:37006 2 949 aba 1656.25 informant and witnesses were assaulted by the applicants and co-accused. It is claimed that in the said incident alleged serious injuries were caused to the informant and witnesses. 3. Learned counsel for the applicants submits that first information report came to be lodged belatedly after five months and considering the version of the informant about intimating to the police as well as to the doctor about the injuries being caused serious doubt is created with regard to the version of the informant in the first information report. It is admitted that there are disputes between the parties and, therefore possibility of false implication of the applicants cannot be ruled out. 4. Learned A. P. P. informs that after completion of the investigation, charge sheet has been filed. He further opposes the grant of any protection to the applicants by citing allegations against them in the first information report, which according to him are supported by the injury certificates on record. 5. Perusal of record indicates that immediately after incident of 06th July, 2024, intimation was given to the medical officer with regard to causing of accidental injuries. It is specifically informed that there was vehicular accident in which they sustained injuries. In the light of said fact, first information report lodged after five months after occurrence of incident creates doubt. Considering the disputes between the parties, possibility of false implication is not ruled out. After granting 3 949 aba 1656.25 interim protection on 04th November, 2025, applicants have cooperated in the investigation. As such after filing of charge sheet, this Court finds no justification not to confirm the interim relief. 6. Hence application is allowed. I pass following order. O R D E R A) In the event of the arrest of the present applicants in connection with Crime No. 695 of 2024, dated 24.12.2024, registered with Shirdi Police Station, Tq. Rahata, Dist. Ahilyanagar for the offenses punishable under Sections 109, 189(1), 189(2), 190, 191(1), 191(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicants shall be released on bail on furnishing a PR Bond of Rs. 50,000/- (Rupees Fifty Thousand only) each, with one or two sureties in the like amount. B) The applicants shall not tamper with the prosecution evidence or influence the witnesses in any manner. C) The Applicants shall not tamper the evidence of the Prosecution in any manner. D) The Applicants shall co-operate during the course of trial. E) Learned APP to communicate this order to the concerned Investigating Officer. [ R. M. JOSHI, J. ] bsb/Aug. 26 4 949 aba 1656.25
