Shekhawat, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 16/01/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.356/2024 registered at Police Station Atru, District Baran for the offence(s) under Sections 115(2), 126(2), 110, 352 and 189(2) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the accused-petitioners also suffered injuries and lodged a cross FIR against the complainant party. The injuries [2025:RJ-JP:2288] (2 of 2) [CRLMB-16214/2024] sustained to injured Omprakash, Chandabai and Pavan were found to be simple in nature, this fact has been referred by the Court below in the impugned order dated 12.12.2024. It is also contended that the accused-petitioners are in custody since long and trial/investigation of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and submitted the factual report. 4. Heard and perused the material available on record. 5. Considering the nature of injuries and period of incarceration of the accused-petitioners, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Lalit Kishore S/o Ghasilal, 2. Lokesh Kumar S/o Ghasilal, 3. Ghasilal S/o Dhulilal and 4.
