This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 390/2024 registered at Police Station – Tilda Nevra, District Raipur (C.G.), for the offence punishable under Sections 296,115(2), 351(2) 3(5), 109 of BNS and 25 and 27 of the Arms Act. 2. As per the prosecution story, the applicant/accused Vinay Dhruv, along with other co-accused, is implicated in Crime No. 390/2024 VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.29 18:45:23 +0530 2 registered at Police Station Tilda Nevra, District Raipur, under Sections 296, 115(2), 351(2), 3(5), 109 BNS and Sections 25, 27 of the Arms Act. It is alleged that the applicant, along with others, attacked the injured person, Ramakrishna Sen, father of the complainant, causing him grievous injuries with a sharp knife. The applicant is alleged to have inflicted several injuries, including on both arms and below them leading to a charge sheet. The applicant contends that he is innocent and is falsely being accused and he is in jail since 16.08.2024, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 3. On the other hand, the learned State Counsel opposes the bail application of the present applicant. 4. I have heard learned counsel appearing for the parties and perused the case diary. 5. Considering the facts and circumstances of the case, the gravity of the offence, and the material available in the case diary, which indicates that the applicant assaulted the injured/victim with a knife, causing injuries to his abdomen and other parts of the body and the same is evident from the MLC report available on record and noting that the trial is in progress and the depositions of only four prosecution witnesses have been recorded so far, this Court is of the opinion that this is not a fit case to grant bail to the applicant. 3 6. Accordingly, the bail application of the applicant – Vinay Dhruv, involved in Crime No. 390/2024 registered at Police Station – Tilda Nevra, District Raipur (C.G.), for the offence punishable under Sections 296,115(2), 351(2) 3(5), 109 of BNS and 25 and 27 of the Arms Act, is rejected. 7.
