Petitioner has been made accused in connection with POCSO Case No. 142 of 2023 arising out of Doranda P.S. Case No. 241 of 2023 for the offences registered under Sections 363, 366A, 376 of the Indian Penal Code and Section 4 of the POCSO Act and charge has been framed for the offences under Sections 363, 366A, 376(2)(n), 376(3) of the Indian Penal Code and Sections 4(2) and 6 of the POCSO Act, pending in the Court of learned Additional Judicial Commissioner-IV-cum-Special Judge, POCSO, Ranchi. 3. On 13.08.2023, the petitioner is alleged to have kidnapped the victim. She was confined in a room for four days. The victim in her deposition recorded during trial has stated that the petitioner also raped her. 4. Mr. Dilip Kumar Prasad, learned counsel appearing for the petitioner has drawn the attention towards the statement of victim recorded under Section 164 Cr.P.C., in which, she has not stated anything regarding physical atrocity committed upon her. 5. As the trial is under progress, it will not be appropriate to look into the contradictions in the statement of victim recorded under Section 164 Cr.P.C. and her deposition recorded during trial. 6. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected. 7. Learned Trial Court shall expedite the trial.
