Since the facts in all the writ petitions are similar and identical, therefore W.P.No.29142 of 2024 is taken as lead case, and the facts therein hereafter will be referred to for convenience. Brief facts of the case are that, the petitioners and their forefathers have been in continuous and peaceful possession of the disputed property for over 100 years through an oral lease arrangement. They have regularly paid the rents and property taxes under the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987. The petitioner and their family have also constructed asbestos sheet house by obtaining necessary approvals. In 2012, the authorities initiated eviction proceedings against the petitioner and neighbouring residents and the learned tribunal has passed an order for eviction. Thereafter, Assistant Commissioner 3. of Nellore allowed them to remain on the property on an enhanced rental basis by paying rents and taxes. In response to a complaint alleging encroachment, the Lokayuktha of Andhra Pradesh vide orders dated 01.05.2024, directed the authorities to remove encroachments and construct a shopping complex. Consequently, on 13.08.2024, the Respondent No.3 issued a notice under Section 83 of the Endowments Act, claiming that the petitioner had no legal entitlement to the property and was an encroacher. The petitioner submitted an explanation on 19.08.2024, asserting their long standing possession, payment of rents and compliance with legal requirements, but however. Respondent No.3 issued an eviction order on 3 26.11.2024, directing the petitioner to vacate the property illegally. Hence, the W.P.No.29142 of 2024 is filed. 4. The pleadings which are cited by the petitioner in W.P.No.29142 of 2024, the same are adopted by the other petitioners in all the remaining writ petitions. Heard Sri Akula Sri Krishna Sai Bhargav and Sri Ram Babu 5. Devarapu, learned counsels appearing for the petitioners and learned counsels appearing for the respondents. On hearing, learned counsel for the petitioners while reiterating 6. the contents urged in the writ petitions, submits that, the respondent authorities issued a notice under Section 83 of the Endowments Act, claiming that the petitioners had no legal entitlement to the property and were encroachers. Though the petitioners submitted the explanations, the respondents have issued eviction orders, directing the petitioners to vacate and surrender possession of the properties, which is illegal and arbitrary. Hence, learned counsel for the petitioners requests this Court to pass appropriate orders. Per Contra, learned counsels appearing for the respondents 7. opposed for allowing these writ petitions and prayed to dismiss the same.
