Opposite Party Mr. U.C.Jena, ASC CORAM: JUSTICE V. NARASINGH Order No. ORDER 27.05.2025 02. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with S.T. Case No.412 of 2025, pending in the Court of learned Addl. Sessions Judge, Pattamundai, arising out of Aul P.S. Case No.706 of 2024, for commission of alleged offence under Section 310 (2) of BNS. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court. 4. Being aggrieved by the rejection of his application by the learned Addl. Sessions Judge, Pattamundai by order dated 07.05.2025, the present BLAPL has been filed. 5. It is submitted by the learned counsel that the co-accused-Gutuli @ Pradeep Malik, Kalia @ Sanjay Malik, Sipua @ Kiran Sethi, Babu @ Jayanta Rout and Papuni @ Hrushikesh Malik have been released on bail by this Court by order dated 14.05.2025 in BLAPL No.2552 of 2025 and since the Petitioner is similarly placed, he may be released on bail. 6. Learned counsel for the State opposes such prayer. 7. It is submitted that like the co-accused who have been released on bail, since the implication of the present Petitioner is on account of the statement of the co-accused, the prayer of the Petitioner may be considered. 8. Taking into account the basis of implication, release of the co-accused and filing of the charge sheet as submitted, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin. 9. Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station once a month on such date and time to be fixed by the learned Court in seisin till conclusion of trial. Certification of such appearance shall be submitted to the Court in seisin. 10. Accordingly, the BLAPL stands disposed of. 11. Urgent certified copy of this order be granted as per the rules. (V.
