Heard Shri Shobhit Mishra, learned counsel for the petitioner. Also heard Shri S.S. Baghel, learned Dy. Govt Advocate. None has appeared on behalf of respondent no. 2. 2. The present Cr.M.P. has been filed with the following prayer:- “(i) That, this Hon'ble Court may kindly be pleased to call for the records pertaining to the case of the applicants. (ii) That, this Hon'ble Court may kindly be please to pass an appropriate order quashing the F.I.R. dated 24/06/2023 bearing Crime No. 0504/2023 registered with Police Station Supela, Durg, Chhattisgarh registered against the Petitioner, in the interest of justice. (iii) That, this Hon'ble Court may kindly be please to pass an appropriate order / direction to the Respondent No. 1 to not take any coercive steps against the Petitioner till the pendency of this petition in connection with the F.I.R. dated 24/06/2023 bearing Crime No. 0504/2023 registered with Police Station Supela, Durg, Chhattisgarh, in the ends of justice. 3 (iv) That, any other relief which this Hon'ble Court may deem fit in the interest of justice, may kindly be awarded.” 3. At the very outset, learned counsel for the petitioner submits that in the present case the charge sheet has been filed and charges have been framed and the case is fixed for evidence stage. He further states that complainant is not appearing, therefore, he wants to withdraw this petition with liberty to take appropriate recourse to law, if any further cause of action arises. 4. No objection from other side. 5. Accordingly, the instant Cr.M.P. is dismissed as withdrawn with the liberty as stated supra.
