By way of this petition, the petitioner has prayed for the following relief:-
“It is, therefore, respectfully prayed that the present petition may kindly be allowed and the case No.1/2025 in case No.4/2023, titled Hir Singh Lal versus Vidya Sagar Sood may kindly be transferred from the Court of learned Deputy Commissioner- cum-Appellate Authority, Kinnaur, District at Reckong Peo, District Kinnaur, H.P. to the Court of learned Deputy Commissioner Shimla in the interest of law and justice.”

The transfer is being prayed of proceedings, which are pending before a Quasi-judicial Authority, i.e., the Deputy Commissioner concerned under the provisions of the Himachal Pradesh Transfer of Land (Regulation) Act, 1968.

This Court is of the considered view that no petition either under Article 227 or Section 24 of the Civil Procedure Code is maintainable, because, Deputy Commissioner is not amenable to the powers of the Superintendence of this Court under Article 227 of the Constitution of India. Similarly, Section 24 of the Civil Procedure Code, which governs transfer of cases inter Courts has no applicability as far as pendency of the proceedings before Quasi-judicial Authorities are concerned.

Accordingly, the petition is dismissed with liberty to the petitioner to invoke such provisions of law as the petitioner may be advised for redressal of his grievance.

Petition is dismissed as withdrawn, so also pending miscellaneous applications, if any.
