JUSTICE SUMATHI JAGADAM WRIT PETITION No.29262 OF 2024 Between: Bobba Nanda Kumar --- Petitioner and The State of A.P., Rep. by its Principal Secretary, Irrigation Department, Secretariat, Velagapudi, Guntur District and 6 others --- Respondents Counsel for the petitioner : Sri Saranu Phani Teja Counsel for the respondents : G.P. for Irrigation & CAD G.P. for Mines & Geology The Court made the following ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: “………..to issue order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the respondents 2 to 5 in allowing the Boatsmen Societies of Dowleswaram Village, Rajahmundry Rural Mandal to dump and transport the sand in the petitioner’s land in an extent of Ac.1.92 cents in Sy.No.583/3 situated in Rajahmundry Urban Mandal, JS,J WP No.29262/2024 2 East Godavari District as wholly illegal, arbitrary and consequently direct the respondents 2 to 5 not to allow any Boatsmen Society of Dowleswaram Village, Rajahmundry Rural Mandal, to dump and transport the sand in my private land situated in Sy.No.583/3 in Rajahmundry Urban Mandal, East Godavari District….” 2. The case of the petitioner, in brief, is that the respondents 2 to 5 are occupying the possession of the petitioner’s land of an extent of Ac.1.92 cents in Survey No.583/3 of Rajahmundry Urban Mandal, East Godavari District. 3. Learned Government Pleader, appearing on behalf of the respondents, on instructions, submits that the Boatsmen Societies are temporarily allocated reach wise ramp point, but as per the objection raised by the petitioner, the allotment of Boatsmen societies are re- allocated to the adjacent Government land and at present there is no desiltation activity occurring in the petitioner’s sand land in an extent of Ac.2.00 cents in RS No.583/3, Rajahmundry Urban, East Godavari District. 4. Recording the aforesaid submission of learned Government Pleader, appearing on behalf of the respondents, the Writ Petition is closed as no further orders are required to be passed in this Writ Petition.
