Hon’ble Mr. Ramesh Sinha, Chief Justice Hon’ble Mr. Bibhu Datta Guru, Judge Order on Board Per Ramesh Sinha, Chief Justice 23/07/2025 1 Heard Mr. Mateen Siddique, learned counsel for the petitioner as well as Mr. Sangharsh Pandey, learned Government Advocate for the State/respondents. 2 By this petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023, the petitioner has prayed for quashing of the FIR bearing Crime No. 694/1992, registered at Police Station, Ambikapur, District 2 Surguja for the offence punishable under Sections 420, 467, 468, 120B of the Indian Penal Code and Section 3(1)(d) of the Prevention of Corruption Act. 3 On the last date of hearing, this Court had directed the learned State counsel to ascertain as to whether any prosecution sanction with respect to the petitioner was granted or not. 4 Mr. Pandey, learned Government Advocate appearing for the State/respondents, on the basis of instructions received, submits that there were two other co-accused persons in this case against which prosecution sanction has been granted but in respect of the present petitioner, no prosecution sanction was granted and ultimately, closure report has also been filed and as such, this petition has been rendered infructuous. 5 In view of the above submission, as the closure report has been filed in respect of the petitioner, nothing survives in this petition for adjudication and this petition stands disposed of.
