FAMILY COURT APPEAL No.167 of 2008 JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand)
It was represented across the bench on 26.03.2025 that the learned counsel for the appellant was no more. Accordingly, Registry was directed to issue notice to the appellant. Pursuant thereto, notice was issued by the Registry, but the same was returned with the postal endorsement that “no such person in the door number”. Hence, it was returned to the sender. 2. This Court made an attempt to serve notice to the appellant at the address mentioned in the appeal. It is the responsibility of the appellant to engage some advocate after the demise of the original counsel. The matter was posted today under the caption ‘for dismissal’ and even today also, there is no representation on behalf of the appellant. All these circumstances indicate that the appellant has no intertest to prosecute the appeal. 3. In view of the same, the Family Court Appeal is dismissed for non-prosecution. There shall be no order as to costs.
