Order 03/01/2025
1. These instant bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.266/2024 Police Station C.P.S. Jaipur, District ACB District for the offences punishable under Sections 7, 7A of Prevention of Corruption (Amendment) Act, 2018 and Section 61(2) of BNS, 2023.
2. It is contended by learned counsel for the petitioners that petitioners have falsely been implicated in this case. Learned counsel for the petitioner-Jaganlal Meena submits that written report was submitted by the complainant dated 04.07.2024 while petitioner joined on his post on 10.10.2024. He further submits that recovery has been made from the drawer of the table.
Learned counsel for the petitioners – Sitaram and Jainarayan Sharma submit that there is no transcript available on record showing the fact that any bribe was demanded by the petitioners. They argue that specific report was submitted by the complainant against Pawan Kumar Jain and Ajay Jhorwal. They further argue that there are no criminal antecedents against the petitioners and trial of the case will take considerable time. They contend that the petitioners are in custody since 14.11.2024 and further custody of the petitioners would not serve any fruitful purpose.
3. Learned Public Prosecutor vehemently opposes the
submissions made by the learned counsel for the petitioners. He
[2025:RJ-JP:368] (3 of 3) [CRLMB-15592/2024] submits that the petitioners have been found in possession of the bribe amount.
4. I have considered the contentions.
5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, especially the fact that absence of criminal antecedents; trial will take time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow these bail applications.
6. These bail applications are accordingly allowed and it is
directed that accused-petitioners – 1. Jaganlal Meena S/o Late Kishorilal, 2. Sitaram S/o Shri Palturam and 3. Jainarayan Sharma S/o Shri Ramprasad Sharma shall be released on bail provided, each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that each of them shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
7. The observation made hereinabove is only for decision of these instant bail applications and would not have any impact on the trial of the case in any manner.
