Neutral Citation No. - 2025:AHC:135883 Court No. - 52 Case :- WRIT - A No. - 11969 of 2019 Petitioner :- Mohammad Akif And 2 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Safiullah Counsel for Respondent :- Arun Kumar,C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J.
1. The notice, endorsed in the notice board as well as in the cause list, dated 11.08.2025, of this Court reads as follows:-
"Notice: old cases up to year 2022 shall be taken up in the first round itself. In the cases, where the cause of action still survives, the concerned advocates are expected to mark them accordingly in the cause list. Failure to do so, may result in its dismissal as infructuous."
2. Despite the aforesaid notice, none appears on behalf of the petitioners, however, Mr. Hare Ram, learned counsel for the State respondents and Mr. A.K. Nagvanshi,
learned counsel for respondent nos. 3 and 4 are present.
3. Record shows that the instant petition has been filed with a prayer to quash the impugned orders dated 28.06.2018, 18.07.2018 and 01.08.2018 and further prayer to direct the respondent no. 4 to accord fresh consideration to representation of the petitioners and to appoint the petitioners as Assistant Teacher Urdu while considering their eligibility.
4. While objecting to the prayer, as made by learned counsel for the petitioners, learned Standing Counsel submits that the petitioners have not been able to place any record to show as to when they took admission for Moalim-E-Urdu Course. Thus, validity of the certificate, as placed by the petitioners claiming the relief, is doubtful. Learned Standing counsel further, emphasizing on page 34 of the writ petition, submits that the certificate in question cannot be said to be valid as the year of admission and the date of issuance of certificate is the same which also proves that the petitioners' certificate is not valid.
5. Taking note of the above submissions as well as taking note that since the petition is of the year 2019 it may be a case where the petitioners have lost interest as after the said endorsed notice, as reproduced above, no one has put in appearance, accordingly, this petition is dismissed.
