The prayer in this writ petition is for issuance of a direction to the respondents to consider the representation of the petitioner, a copy of which is produced at Annexure-A, by which, the petitioner is seeking revalidation of Development Rights - 3 - NC: 2025:KHC:8914 WP No. 32464 of 2024 Certificate and to make necessary update in the official register. 2. It is not in dispute that the Development Rights Certificate was given to the petitioner on 01.09.2010 vide Annexure-E and this Development Rights Certificate indicated that it was valid only for a period of five years. The petitioner has thereafter given a representation requesting the 3rd respondent to revalidate the said certificate and since the same has not been considered, the she is before this Court. 3. Clause (5) of Regulation 10.1 of the Zonal Regulations reads as follows: “The D.R.C. shall be valid for a period of five years. However, the same may be revalidated for a further period of five years subject to payment of revalidation fee.” 4. As could be seen from the said clause, the Development Rights Certificate would have to be necessarily revalidated for further period of 5 years, subject, however to the payment of revalidation fee. - 4 - NC: 2025:KHC:8914 WP No. 32464 of 2024 5. In light of this particular clause which entitles the petitioner to seek revalidation of said Certificate, the 3rd respondent is directed to revalidate the Development Rights Certificate after collecting necessary revalidation fee from the petitioner. 6. The said exercise shall be undertaken and completed within a period of two months from the date of receipt of a copy of this order. 7. The writ petition is accordingly disposed of.
