Heard the parties.
The petitioners have been made accused in connection with Pakur (M) P.S. Case No. 149 of 2025, for the offences registered under Sections 126(2), 115(2), 117(2), 109, 324(4), 74, 303(2), 352, 351(3), 3(5) of the B.N.S., 2023, pending in the court of learned S.D.J.M., Pakur. Petitioners and the informant parties are neighbours. It is alleged that smoke emanating from the house of the informant was entering into house of the petitioners, due to which there was some altercation and free fight ensued between the parties, on the common path way. It is further alleged that both the parties sustained injuries. It was submitted that there is case and counter case between the parties with regard to the same occurrence. It was further submitted that the occurrence was not premediated, rather it was the result of sudden fight.
Learned counsel for the informant has opposed the prayer for bail and submitted that one of the injured has sustained grievous injuries. Considering the nature of allegation and fact that there is case and counter case between the parties with regard to the same occurrence, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Pakur, in connection with Pakur (M) P.S. Case No. 149 of 2025.
