PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 8981 of 2024 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused No.5, seeking regular bail, in Crime No.85 of 2024 of Maredumalli P.S., East Godavari District. 2. Case of the prosecution, in brief, is that this is a case of illegal possession and transportation of Ganja that occurred on 28.10.2024 at 3.00 PM at PM Kota Junction, suburbs of Kuduru Village of Maredumilli Mandal, wherein S.I. of Police, Maredumilli arrested the petitioner/A-5 while he was in possession and transportation of Ganja from Disaraguda Village to Rajamahendravaram with the active instigation of A-1 to A-4 (absconding) and the S.I. of Police, Maredumilli seized 14 bags each containing 28 kgs of Ganja and one bag containing 10kgs of Ganja, total 402 kgs of Ganja apart from seizing silver coloured Mahindra Bolero van bearing No. OR05AE2517, Maroon and black coloured Hero Honda CD dawn motorcycle bearing No. AP05BC 3655. Consequently, a crime has been registered against the accused. 3. Heard the learned Counsel for the petitioner and learned Assistant Public Prosecutor representing on behalf of the State. Perused the record. 4. Learned Counsel for the Petitioner would submit that the Petitioner is entitled for statutory bail. 3 5. Learned Assistant Public Prosecutor would submit that the Petition may be disposed of giving liberty to the petitioner to move such application before the Special Court. 6. Considering the submissions made, the Criminal Petition is disposed of. However, the Petitioner is at liberty to file a petition before the Special Court and on filing such petition, learned Special Judge, is directed to dispose of the same as expeditiously as possible preferably on the very same date. 7. Accordingly, the Criminal Petition is disposed of.
