Heard the parties.
The petitioner has been made accused in connection with Sahibganj (Mahila) P.S. Case No. 10 of 2025, for the offences registered under Sections 69, 89, 352, 351(2), (3) of the B.N.S., 2023, pending in the court of learned Chief Judicial Magistrate, Sahibganj. On the pretext of marriage, the petitioner is alleged to have established physical relationship with the prosecutrix, who is a major lady aged about 23 years. Later on, the petitioner refused to marry her.
Learned counsel for the informant has opposed the prayer for bail and submitted that victim had become pregnant. Considering the fact that there was consensual physical relationship between two adults, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (Mahila) P.S. Case No. 10 of 2025.
