2.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 13.11.2022. Charge-sheet has been filed against the petitioner. Learned counsel for the petitioner further submits that there is no evidence against the petitioner that he had committed murder of Vijendra Singh. Learned counsel for the petitioner also
[2025:RJ-JP:6132] (2 of 2) [CRLMB-16322/2024] submits that petitioner was implicated in this case on account of CCTV footage. Learned counsel for the petitioner also submits that during trial, PW2-Babu Lal in his cross-examination stated that he could not say as to who was sitting on which vehicle. Learned counsel for the petitioner further submits that nothing was recovered from the petitioner. Conclusion of trial may take long time. So, the petitioner be enlarged on bail.
3. Learned GA-cum-AAG has opposed the arguments advanced by learned counsel for the petitioner and submitted that the petitioner and co-accused Baljit Singh had hatched a conspiracy and played an active role in committing the murder of deceased- Vijendra Singh. So, the 4th bail application filed by the petitioner be dismissed.
4. I have considered the arguments advanced by learned counsel for the petitioner as well as learned GA-cum-AAG.
5. During the investigation, Investigating Officer had collected evidence from which it is revealed that the petitioner and co- accused Baljit Singh had played an active role in committing the murder of deceased-Vijendra Singh. As per the CCTV footage, the petitioner was present near the house of the deceased while he was recceing before the incident. So, looking to the gravity of offence and nature of allegation(s), I do not consider it a fit case to enlarge the petitioner on bail.
5. Consequently, this 4th bail application is dismissed.
