Respondent(s) (Cause Title is taken from Case Information System) For Petitioner : Mr. Alok Dewangan, Advocate For State : Mr. Vedant Shadangi, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board Digitally signed by NADIM MOHLE -2- 26.06.2025 1) Petitioner has filed this petition seeking the following relief(s):- “10.1.That, this Hon'ble High Court may kindly be pleased to direct the concerned respondent authorities, to decide the pending representation of the petitioner for granting patta of Agricultural Land Khasra No. 20 Rakba 7.10/2.873 and for residential purpose plot bearing Khasra No. 55 Rakba 0.15/7061 Acre Land which, was allotted to them by the Government when they were settled in the year 1959 under Dandakaranya Project. 10.2 That, this Hon'ble High Court may kindly be pleased to direct the concerned respondent authorities, that the property of the petitioner le; Agricultural Land Khasra No. 20 Rakba 7.10/2.873 and for residential purpose plot bearing Khasra No. 55 Rakba 0.15/7061 Acre Land situated at Village Boregaon West, Tahsil Farasgaon, District Kondagaon, C.G. should not be allotted to any other person or declared as Nazul Land. 10.3 That, this Hon'ble High Court may kindly be pleased to direct the concerned respondent authorities to visit the spot and carryout the demarcation with respect to the petitioners land, in accordance with law with in stipulated time frame and grant patta for which petitioner is entitled to get. 10.4 This Hon'ble High Court may kindly be pleased to restrain the respondent revenue authorities, who are the concerned authorities in this regard, that they should not mutate the land of the petitioner in the name of others on back date if not mutated, in the revenue records, under influence, in an illegal manner. 10.5 This Hon'ble High Court may kindly be pleased to pass any other orders, writ or direction in favour of the petitioner as it may deem fit under the facts and circumstances of the case.” -3- 2) Mr. Dewangan, learned counsel for the petitioner would submit that the petitioner has moved an application for grant of lease in respect of land bearing Survey No. 55, admeasuring 0.15 acre, and Survey No. 20, admeasuring 7.10 acre, situated at Village Borgaon, District Kondagaon. It is submitted that the petitioner is in possession of the said plots since 1959. The application for grant of lease was submitted before the Tehsildar on 23.09.2021; however, the same has not been decided till date. He would pray that appropriate direction may be issued to the concerned authority to decide the said pending application. 3) On the other hand, Mr. Vedang Shadangi, learned Panel Lawyer for the State, opposes the submission. 4) Heard. 5) Taking into consideration the limited grievance of the petitioners, at this stage, this petition is disposed of with a direction to the concerned Tehsildar to decide the pending application dated 23.09.2021 for grant of lease expeditiously, preferably within a period of 150 days from the date of receipt of a copy of this order. 6) Accordingly, the instant writ petition is hereby disposed of at the admission stage itself.
