2. Petitioner has been made accused in connection with Chandwa P.S. Case No. 74 of 2024 corresponding to N.D.P.S. Case No. 1 of 2025 for the offences registered under section 17 of the N.D.P.S. Act, pending in the court of learned Special Judge (I/C), Latehar.
3. Bail application of the petitioner was earlier dismissed as withdrawn by this court vide B.A. No. 10675 of 2024 by order dated 13.02.2025.
4. On 08.06.2024, Chandwa Police on the basis of confidential information, apprehended this petitioner from the Bus Stand near Subhash Chowk. On search, 5.657 kg. of opium was recovered from his possession.
5. Report regarding the stage of the trial earlier called for, has been received, it appears that charge was framed on 15.02.2025 and out of five witnesses, three have already been examined. Learned Trial Court has reported that the trial was likely to conclude within five months.
6. Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected, at this stage.
