Mr. K.N. Joshi, Deputy Advocate General for the State of Uttarakhand / respondents. 3. According to the petitioners, they had residential houses near ‘Kedarnath Shrine’, which were washed away, during catastrophe, which hit State of Uttarakhand in 2013. 4. By means of this writ petition, petitioners have sought the following relief:- “i) Issue a writ, order or direction, in the nature of mandamus commanding the respondents to determine the quantum of compensation in accordance with the Government order dated 6-4-2015 and to pay the same to the petitioners. ii) Issue a writ, order or direction, in the nature of mandamus commanding the respondents to comply with the provisions contained under Clause 10 of the Government order dated 6-4-2015 and to allocate an area adjoining to the 50 to 52 wide passage as now determined by the respondents.” 5. Learned State Counsel submits that since petitioners have sought a writ of mandamus, therefore, writ petition can be disposed of granting liberty to petitioners to make representation. 6. This Court finds substance in the said submission. 7. Since the authorities are yet to examine petitioners’ claim for compensation, therefore, the writ petition is disposed of with liberty to petitioners to make representation to the Secretary, Rehabilitation, Uttarakhand. If they make representation, within three weeks from today, decision thereupon shall be taken, as per law, within nine months thereafter.
