OIC Ltd. vs. Roop Chand & others
FAO No. 526 of 2019
12.12.2025 Present: Dr. Lalit K. Sharma, Advocate, for the appellants.
Mr. K.S. Kanwar, Advocate, for respondent No.1.
Mr. Praveen Chandel, Advocate, for respondents No. 4 and 5.
CMP No. 27868 of 2025
This application has been filed by the applicant/claimant for release of award amount lying in deposit in the Registry of this Court in pending FAO No. 526 of 2019.
Record reveals that the compensation has been awarded to the applicant/claimant by the learned Tribunal on account of personal injuries and consequent disablement suffered by him.
As per applicant/claimant, he is in need of money to pay the debts which he had to incur for the treatment. He also requires the amount for his further treatment.
No reply has been filed to the application.
The accident had taken place in the year
2014. More than ten years have elapsed and the claimant has not been able to get the compensation.
The instant appeal is likely to take more time before final disposal.
Keeping in view the peculiar facts of the case, I find it expedient to allow the application by directing to release 50% of the award amount lying in deposit in this Court in favour of the applicant/ claimant, by remitting the same directly to his bank account, as detailed in para-4 of the application, after due verification. The application stands disposed of.
