CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Ashish Kr. Shekhar, Advocate For the State : Ms. Bandana Sinha, AddI. P.P.
…...... 02/ 17.10.2025: This is the 3rd attempt by the petitioner seeking bail.
2. By filing this application, the petitioner prays for grant of bail in Kunda P.S. Case No. 20 of 2017, pending in the Court of learned Sessions Judge, Deoghar in S.T. No. 418 of 2023 under Section(s) 302/307/120B of the Indian Penal Code and Section(s) 25(1- B)(a)/26/27/35 of the Arms Act.
3. Heard the learned counsel for the petitioner and the learned counsel for the State.
4. The learned counsel for the State has opposed the prayer for bail of the petitioner.
5. Petitioner is in custody since 18.05.2023.
6. On the last occasion, prayer for bail of the petitioner was rejected by this Court when affidavit filed by the Superintendent of Police, Deoghar was taken note of. In the said affidavit it was mentioned that nine (09) witnesses were already been examined and rest of the witnesses will be produced within 90 days.
7. Today when the matter is taken up, it has been brought to notice of this Court that out of 21 witnesses, 05 remains to be examined in this case.
8. There is an allegation against this petitioner that while he was in custody, he hatched a conspiracy, as a result of which husband of the
rival candidate of his wife in the Mukhiya election, was murdered.
9. Considering the nature of allegation and the gravity and considering the fact that only five witnesses remains to be examined in this case, I direct the Superintendent of Police, Deoghar to ensure that the rest of five witnesses be examined by November, 2025. The Trial Court will monitor this case on day-to-day basis and will examine the witnesses.
10. This bail application is dismissed with the aforesaid direction.
