Order 03/01/2025
1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.38/2023, registered at Police Station Special Police Station (S.O.G.), District A.T.S. and S.O.G. for the offence(s) under Sections 419, 420, 467,
[2025:RJ-JP:297] (2 of 3) [CRLMB-15819/2024] 468 and 120-B of IPC and Sections 3/10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.
2.
Learned counsel for the petitioner-Vimla Visnoi submits that the accused-petitioner has falsely been implicated in this case. It is contended that petitioner-Vimla Visnoi is in custody since 12.12.2024 and the other similarly placed co-accused have already been enlarged on bail, the matter of present petitioner is akin to the other co-accused. The accused-petitioner-Vimla Visnoi is having baby boy child of 11 months, therefore, considering the above facts, the bail application of the accused-petitioner-Vimla Visnoi may be allowed.
3.
Learned counsel for the petitioner-Kamal Vishnoi submits that the accused-petitioner-Kamal Vishnoi is in custody since 26.11.2024 and his case is also akin to the other co-accused, who have already been enlarged on bail by this Court. It is also contended that co-accused Gopal Singh was enlarged on bail by the learned trial Court, therefore, considering the above facts, the bail application of the accused-petitioner-Kamal Vishnoi may also be allowed.
4. Learned Public Prosecutor has vehemently opposed the grant of bail applications and submitted the factual report. It is contended that the other co-accused, who have already been enlarged on bail remained in custody for long period and period of custody of the present petitioners are not sufficient to grant them bail. It is alleged against the accused-petitioners that they along with other co-accused engaged other candidates to appear on their behalf in the examination conducted by the R.P.S.C. It is also
[2025:RJ-JP:297] (3 of 3) [CRLMB-15819/2024] contended that both the accused-petitioners did not co-operate with the investigation and the candidates who appeared on their behalf are yet to be traced, therefore, considering the gravity of the offence, the bail application of both the petitioners are liable to be dismissed.
5. Heard and perused the material available on the record.
6. It is not desirable to express anything on the merits of the case, considering the fact that the other similarly placed co- accused have already been enlarged on bail by this Court and the matter of the present petitioners are akin to the case of the other co-accused, I deem it just and proper to enlarge the accused- petitioners on bail.
7. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused- petitioners, namely; 1. Kamal Vishnoi S/o Shri Aasuram Vishnoi and 2. Vimla Visnoi D/o Shri Manaram, in connection with FIR No.38/2023, registered at Police Station Special Police Station (S.O.G.), District A.T.S. and S.O.G., shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
