It is the case of the petitioner that the respondents are seizing the stone crushing machine No.NW7150C, Model No.B7150SE, mounted on the chassis No.066/01/08, along with the prime mover No.TN01 AF0873, as per Check Report No.044002, dated 11.04.2014, by the 4th respondent, on the ground that the same is Motor Vehicle and has to be subjected to Motor Vehicle Tax, which is contrary to the law. The petitioner seeks the release of the said vehicle. 3. The petitioner further relies upon the judgment in Khader Basha and others v. Regional Transport Officer, Chittoor and others1. 4. The petitioner argues that the respondents should determine the liability for the life tax, and in the absence of such determination, the respondents cannot seize the vehicle under the guise of non-payment of the life tax. Hence, the present writ petition. 1 2012 (6) ALT 660 (D.B.) 3 5. At this stage, this Court passed an interim order on 29.04.2014, directing the petitioner to deposit a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand Only), pursuant to which the respondents released the vehicle. 6. Learned Government Pleader for Transport appearing for the respondents submits that, in view of the interim orders of this Court dated 29.04.2014, the vehicle has already been released, and no further orders are necessary in this Writ Petition, as the grievance of the petitioner pertains to the interim order. 7. Having regard to the submissions made by learned Government Pleader for Transport appearing for the respondents, this Court is of the considered view that the present Writ Petition can be disposed of directing the respondents not to take any coercive steps without following due process of law. 8. Accordingly, the Writ Petition is disposed of. No order as to costs.
