In the present writ petition, the petitioner herein is a Government Constable posted at Divisional Excise Office, Bilaspur, earlier he was posted in the Office of Assistant Commissioner, Excise, Korba. Vide order dated 23/06/2022, the petitioner was transferred from Korba to Bilaspur, however, he is retaining the government Quarter No. N.G.-18 at revenue colony Kuhadiya, Korba, which was allotted to the petitioner in the year 2011. 2. Learned counsel for the petitioner submits that the petitioner’s family including her daughter namely Disha Lehre, who is studying in Class 12th at St. Xaviers Public School, Korba are residing in Korba in the quarter allotted to him. However, vide notice dated 06/01/2025, the petitioner has been directed to vacate the government quarter immediately. He further submits that as the petitioner’s daughter is studying in Class 12th and practical examination has already been started, the petitioner be allowed to stay in the allotted house in Korba till the first week of April, 2025 to facilitate the petitioner’s daughter to appear in the examination. 3. Learned counsel for the State/respondent submits that the petitioner has been transferred in the year 2022 and he has not vacated the house allotted to him till date, hence, no relief should be granted to the petitioner. 4. I have heard learned counsel for the parties. 5. Looking to the fact that the petitioner’s daughter is appearing in Class 12th Board Examination and she is a student of St. Xaviers 3 Public School, Korba and the practical examination of the Class 12th has already been started, which is reflected from Annexure P- 4, hence, the impugned notice dated 06/01/2025 shall remain stayed till 10th of April, 2025. The petitioner shall not be evicted from the allotted house at Korba till 10th April, 2025. 6. With the aforesaid observation(s) and direction(s), the writ petition is disposed.
