Heard the parties.
Petitioner has been made accused in connection with Lohardaga P.S. Case No. 260 of 2023, corresponding to Drugs and Cosmetic Case No. 01 of 2024, for the offence registered under Sections 276, 406 & 417/34 of I.P.C., Section 27(d) of the Drugs and Cosmetics Act and Sections 21 and 22 of the N.D.P.S. Act. Thereafter, charge has been framed under Section 21(c) of the N.D.P.S. Act and Section 27(d) of the Drugs and Cosmetics Act, pending in the court of learned Additional Sessions Judge-II-cum- Special Judge, Lohardaga. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.10801 of 2024 by order dated 25.04.2025 with liberty to renew his prayer for bail after four months. It appears that 119 bottles of Onerex cough syrup were recovered from the possession of the petitioner. It further appears that the quantum of seized cough syrup comes within the purview of commercial quantity. Earlier while rejecting the bail application of the petitioner, report regarding the stage of trial and time required for its conclusion was called for. It appears that out of 13 chargesheeted witnesses, 5 witnesses have been examined. It has further been stated that the trial will be concluded within two months.
Learned counsel appearing on behalf of the petitioner has relied upon the order of Hon’ble Supreme Court in the case of Miku Kumar Yadav @ Mikku Kumar Yadav Vrs. The State of Jharkhand in [Special Leave to Appeal (Crl.) No. 148 of 2025] where the Hon’ble Apex Court has

considered the period of custody of the petitioner in that case and granted bail to him. Petitioner in that case was in custody for more than two years.
Learned counsel has further submitted that the petitioner has remained in custody since 03.09.2023. It was further submitted that there was no progress in trial after earlier rejection of the petitioner. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Lohardaga, in connection with Lohardaga P.S. Case No. 260 of 2023, corresponding to Drugs and Cosmetic Case No. 01 of 2024.
