DATED: 13th June, 2025 ORAL JUDGMENT: 1. Heard learned Counsel for the parties. 2. Rule. Rule made returnable forthwith. With the consent of the parties, petition is disposed of finally. 3. This Writ Petition impugns orders dated 29.09.2023 and 06.11.2023 passed by the Principal District & Sessions Court, North Goa at Panaji in Land Acquisition Case No.21/2011. 4. By the first impugned order, the District Court has dismissed the application filed by the State for production of a document which is an agreement between the State and its consultant dated 29.01.2009. 5. By the second impugned order, the District Court has dismissed the review application holding that the document was incomplete and the Respondent is unable to show the relevance of this document. 6. After hearing this matter for some time, it would be appropriate that, subject to deciding the relevance of the document at the final hearing stage, the same may be produced in evidence through a witness, subject to its proof. It is noticed that the document sought to 11 WP 225-2025 13th June, 2025 be produced is incomplete on its face, since Annexure 1 to Appendix D, is missing. So also it appears that Annexures 3 and 4 of which Annexure 4 is referred to in Appendixes B and C are also missing. 7. Consequently, the impugned orders, by consent, are set aside. The District Court is directed to allow the Petitioner/Directorate of Sports and Youth Affairs to examine its witness and produce/tender this document in evidence, subject to its proof and subject to the objections/cross examination on the missing Annexures/Appendixes. The question of relevance of the document may also be decided after it is produced and cross examination thereon is complete, at the stage of final arguments. 8. Rule is made absolute in the above terms. 9. Petition stands disposed of. No costs. 10. In view of the disposal of this petition, pending Misc. Civil Applications also stand disposed of.
