Neutral Citation No. - 2025:AHC:130377 Court No. - 4 Case :- WRIT - A No. - 12846 of 2021 Petitioner :- Dr. Priti Sinha Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Sourabh Pathak,Sr. Advocate,Varun Kumar Srivastava Counsel for Respondent :- C.S.C.,Chandan Sharma,Prabhat Kumar Singh Hon'ble Ajit Kumar,J. 1. Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri Sameer Srivastava and Sri Varun Kumar Srivastava, learned counsel for the petitioner and Sri V.K. Singh, learned Senior Advocate assisted by Sri Chandan Sharma, learned counsel for the respondents and learned Standing Counsel appearing for respondent nos.1,2 and 3. 2. It is agreed by learned Senior Advocates appearing for respective parties that ground realities and circumstances that were there at the time when petition was entertained, have changed by with the passage of time and therefore, now authority competent in the matter is required to relook the matter and pass fresh order qua transfer of petitioner and the contesting respondent. 3. Petitioner admittedly wanted to stay back at Meerut on the ground that she was to look after her ailing and aged mother inasmuch as her husband was doing private practice of medicine at Meerut. The fifth respondent had his own claim for posting at Meerut inasmuch as had also medical issues with his child as he was suffering from autism. 4. In the circumstances therefore, the Court considers it appropriate for the State to pass fresh order after considering the respective claims in the face of the fact that various new Government Medical Colleges and autonomous Medical Colleges have come to be opened in districts near to district Meerut where these litigating parties may be adjusted. 5. In the circumstances therefore, I consider it appropriate to remit the matter to respondent no.1 to take decision afresh regarding posting of petitioner and the fifth respondent and both the parties are also directed to represent their respective cases before respondent no.1 within a period of two weeks from today. The appropriate decision shall be taken by the concerned respondent no.1 within a further period of six weeks. 6. Let the status quo be maintained in respect of the posting of the petitioner and the fifth respondent as existing on date till the decision is taken. 7. In the circumstances both the orders dated 08.09.2021 impugned in this petition are hereby quashed. 8. Writ petition stands disposed of as above.
