The present under Article 226 of the Constitution of India has been filed by the petitioner with the following prayers :- “10.1. That, this Hon’ble Court may be kind enough in issuing a writ in the nature of mandamus, certiorari or likewise any other appropriate writ, by quashing the order dated 31.12.2024 and direct the concerned court to grant No Objection Certificate for renewal of passport bearing Passport No. M4884411 of petitioner, with immediate effect. 10.2. Any other relief, That, this Hon’ble Court may be kind enough in issuing a writ in the nature of mandamus, certiorari or likewise any other appropriate writ, order or commands, commanding and directing the respondents which the Hon’ble Court deems fit and proper looking to the facts and circumstances of the case, may also be granted.” 3. Mr. Ramakant Mishra, learned Deputy Solicitor General, appearing for the Union of India / respondent No.1 submitted that an application for issuance of No Objection Certificate for renewal of passport of the petitioner has been rejected by the concerned trial Court on the ground a criminal case is pending against the petitioner, which is subject matter of challenge before this Court in in the present petition i.e. WPCR and it is stated that WPCR is not maintainable against the said order as the petitioner is having 3 alternative remedy to move an application before the appropriate Court. 4. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the instant petition to final an appropriate application before the appropriate Court. 5. Accordingly, the instant petition is dismissed as withdrawn with liberty as prayed for. 6. Certified copy of the relevant documents annexed along with the writ petition be returned back to the counsel for the petitioner after retaining photocopy of the same.
