--- CORAM:
HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY
HON'BLE MR. JUSTICE AMBUJ NATH
For the Appellant : Mr. Tarun Kumar No.1, Advocate For the State
: Mrs. Vandana Bharti, A.P.P.
--- 11/29.04.2025
Heard Mr. Tarun Kumar No.1, the learned counsel for the appellant and Mrs. Vandana Bharti, the learned A.P.P. for the State.
This appeal is directed against the order dated 02.07.2024 passed by the learned Additional Sessions Judge- 1st- Special Judge, Bokaro in Sessions Trial Case No. 496 of 2022, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been submitted by the learned counsel for the appellant that some of the co-accused similarly situated to that of the appellant, namely, Dinesh Yadav and Umesh Mahato have been granted bail by a co-ordinate Bench of this Court in Criminal Appeal (DB) No. 129 of 2023 and Criminal Appeal (DB) No. 37 of 2023. It has further been submitted that Umesh Mahto was also identified in Test Identification Parade and money was also recovered from his possession. Since he has been granted bail, therefore, on the ground of parity bail has been sought for on behalf of the appellant. It has further been submitted that the appellant is in custody since 02.07.2022.
Learned A.P.P. has opposed the prayer for bail of the appellant.
This is a case of Bank dacoity. It appears that two persons had identified the appellant and an amount of more than Rs.4,00,000/- was also recovered from the appellant. Though it has been submitted by the learned counsel for the appellant that Umesh Mahato has been granted bail by a co-ordinate Bench of this Court but being faced with the materials against the appellant, as noted above, we are not inclined to interfere in the impugned order dated 02.07.2024 passed by the learned Additional Sessions Judge- 1st- Special Judge, Bokaro in Sessions Trial Case No. 496 of 2022 and consequently, we dismiss this appeal.
