O R D E R:
This writ petition under Article 226 of the Constitution of India is filed for the following relief:
“…to Issue a Writ or Order or Direction more particularly one in the Nature of a Writ of Mandamus declaring the action of the Respondents particularly the 4th Respondent taking the 1st Petitioners Vehicle Honda Amaze,Grey Colour,Taxi Cab, bearing Reg., No.AP 39 UL 4344 along with Cash of Rs. 10,500/-, Vivo Smart mobile phone from the possession of 2nd respondent i.e., driver of the vehicle, while the petitioner no.2 was sleeping in the Car at 02.30 A.M., on 03 rd December, 2024 , Illegally, Unlawfully, without any registration of a Crime or panchanama all are Violation of Procedure, Violation of Article 14,19,21 of the Constitution of India Consequently to direct the Respondents 3 and 4 to return the Petitioners Vehicle
Vehicle Honda Amaze,Grey Colour,Taxi Cab, bearing Reg., No.AP 39 UL 4344 along with Mobile Phone and Cash of Rs. 10,500/- and to pass......”
2. Heard Sri R.Siva Sai Swarup, learned counsel for the petitioners and learned Additional Government Pleader for Home. 3. Learned Additional Government Pleader for Home on written instructions would submit that police registered a case in Cr.No.272 of 2024 on 03.12.2024 for the offence under Section
4 9(1) of A.P. Gaming Act, and during investigation vehicles and mobiles were seized and investigation being under progress. 4.
In that view of the matter, the petitioner is at liberty to approach the jurisdictional Magistrate with an application for interim custody. On filing of such application, the learned Magistrate is directed to consider and dispose of the same, as expeditiously as possible, preferably within a period of one week. With that observation writ petition can be closed, without going into the merits of the case. 5. The submissions of the learned Additional Government Pleader for Home are placed on record. The learned counsel for petitioner also consented to dispose of the writ petition. 6. Accordingly, the Writ Petition is closed at the stage of admission with the above direction. There shall be no order as to costs. As a sequel thereto, the interlocutory applications, if any, pending in this Writ Petition shall stand closed. ______________________________ JUSTICE B.V.L.N.
