Ms. Srijani Ghosh, Adv. …for the petitioner The Court:- This is an application for grant of probate of the last Will and Testament dated February 13, 2014 left behind by the abovenamed deceased. The Will was registered in the office of the Additional District Sub- Registrar on February 13, 2014. The husband of the testatrix predeceased her. The Will reveals that the testatrix died issueless. The husband of the testatrix had two sons from his first wife. The petition reveals that the petitioner has not been in contact with the said two step sons of the testatrix. None has come forward to oppose the grant. The Department has issued ‘No Caveat Certificate’ indicating that despite issuance of citation and publication thereof, no caveat has been entered against the grant of probate of the aforesaid Will. The Will has been proved in common form by one of the attesting witnesses. In such view of the matter, since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, having regard to the above and considering the view of 2 the Department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the application.
