AGP Mr. Parikshit Goswami … for the State – Respondent(s) Re The petitioners are aggrieved by the fact that inspite of an ad interim injunction order being passed by the learned Civil Judge (Jr. Divn.), 3rd Court, Baruipur in connection with TS 15 of 2005 and, subsequently, specific directions being passed upon the police authorities, there has been violation in terms of the said order at the behest of the private respondents. The petitioners, as such, are suffering irreparable loss and injury. State has submitted a report prepared by the Inspector-in-charge of Kultali police station which reflects that a long standing land dispute is pending, as such, the police authorities have drawn up a proceeding under Sections 126/135(3) of the BNSS. Having considered that there is a long standing land dispute, being TS 15 of 2005, which is still existing between the petitioners and the private respondents, I am of the opinion that if there has been any breach of the order passed by the learned civil court, the petitioners would approach the said civil court for addressing their grievances. So far as the police authorities are concerned, they have already drawn up a proceeding under Section 126/135(3) of the BNSS, as such, they are acquainted with the disputes which is existing at the ground reality. If there is any violation of law and order, the police authorities would take steps in accordance with law. With the aforesaid observations, WPA 17712 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. A copy of the report be handed over to the petitioners.
