...CONTEMNOR(S): Petition under Sections 10 to 12 of Contempt of Courts Act 1971 praying that in the circumstances stated in the affidavit file herein the High Court may be pleased to pleased to punish the Respondents Authorities herein for their willful disobedience of the Interim Order of this Hon'ble Court passed in W.P.No.25912 of 2023 dated 04.10.2023, passed by his Lordship Justice Ravi Cheemalapati under Sections 10 to 12, 14, 15 and 16 of Act, 70 of 1971 (Contempt of Courts Act), and pass Counsel for the Petitioner:

The Court made the following:
ORDER:
This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971, for the willful disobedience of the orders dated 04.10.2023 passed in W.P.No.25912 of 2023.

Learned counsel for the petitioner submitted that in spite of the direction given by this Court not to take any coercive steps, respondents are interfering with the petitioner’s construction activity and further an FIR was also registered against him as he has proceeded with the construction work, as such, there is willful disobedience on the part of the respondents and liable for punishment.

Learned counsel for the respondents submitted that pursuant to the orders passed by this Court dated 04.10.2023, a Coordinate Bench of this Court passed another order on 08.01.2025 wherein and whereby permission was granted to the petitioner to proceed with the construction. However, it is observed that the said permission was subject to the outcome of the writ petition. Purusantly, the respondents are not interfering with the petitioners construction activity. In view of the same, petitioner cannot allege that the respondents have violated the orders passed by this Court and liable for punishment.
4. This Court on 04.10.2023, directed the respondent authorities not to take any coercive steps. Now, another order dated 08.01.2025 was placed on record wherein this Court passed another order permitting the petitioner to proceed with the construction and the said permission is subject to outcome of
the writ petition. The contention of the respondents is that they are not interfering with the petitioners construction. In view of the same, the contempt is liable to be closed.
5. Accordingly, the Contempt Case is closed. However, if the authorities try to interfere with the said construction, petitioner can always take steps in that regard. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending if any, shall stand closed. _____________________________
