(At Present In Sub Jail Chabra, District Baran). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Rajendra Yadav, Mr. Vishnu Kumar Sharma For Respondent(s) : Mr. Shriram Dhakad PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 08/01/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 325/2024, registered at Police Station Chabra, District Baran, for the offences under Sections 109(1), 115(2) and 352 of B.N.S.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that the concerned medical jurist in his opinion has clearly mentioned that injury No.1 caused to injured-Kamal is simple sharp in nature. It is alleged against the accused-petitioner that he caused fatal injury at the back of the injured-Kamal with a knife. The said injury was found to be simple sharp in nature. Apart from this injury, there were no other sharp injuries found on the body part of the injured-Kamal. The accused-petitioner is behind the bars since 28.08.2024 and charge-sheet has already been submitted. The case under Section 109(1) and 115(2) of BNS is not made out
[2025:RJ-JP:1168] (2 of 2) [CRLMB-16108/2024] against the accused petitioner, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and it is contended that the accused-petitioner caused injury with the knife at the back of the injured-Kamal and injured remained in hospitalised for the said injury from 21.08.2024 to 24.08.2024, therefore, considering the weapon used by the accused-petitioner and injury caused to the injured, the bail application of the accused petitioner deserves to be dismissed.
4. Heard and perused the material available on the record.
5. The medical jurist has opined that the injury No.1 is found to be simple in nature, apart from the one injury there is no other injuries caused to the injured with the aid of knife. There is no criminal antecedents against the accused-petitioner. The accused- petitioner has remained in custody for almost 5 months and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Anil Kumar Jatav S/o Jagannath, in connection with FIR No. 325/2024, registered at Police Station Chabra, District Baran, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
