23/07/2025 1 Heard Mr. Vivek Mishra, learned counsel for the petitioners as well as Mr. S.S.Baghel, learned Deputy Government Advocate for the State/respondent No. 1. 2 2 By this petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023, the petitioners seek quashing of the FIR bearing Crime No. 679/2023, for the offences under Sections 420, 467, 468 and 471 read with Section 34 of the Indian Penal Code registered on 10.08.2023 by the police of Police Station, Khamtarai, District Raipur. 3 On the last date of hearing, this Court had directed the Superintendent of Police, Raipur, to file his personal affidavit to explain as to why the investigation could not be concluded till date when the FIR was lodged way back on 10.08.2023. 4 Pursuant to the above direction, the Deputy Inspector General and Senior Superintendent of Police, Raipur, has filed his affidavit stating that the concerned Investigating Officer was found to be negligent in investigating the case and keeping the case pending for a long time without any reason, therefore, a punishment of censure has been imposed upon him. 5 Mr. Baghel, learned State counsel submits that now the investigation has been concluded and charge sheet has also been filed before the competent Court and as such, this petition has become infructuous as the petitioner had challenged the registration of the FIR. 6 In view of the above, Mr.
Mishra, learned counsel for the petitioners submit that he may be permitted to withdraw this petition with liberty to challenge the charge sheet before the appropriate forum. 7 Accordingly, this petition is dismissed as withdrawn with liberty reserved to the petitioners to take recourse to law, if so advised.
