Learned counsel for the applicant and learned AGA for the State are present. 2. The present application under Section 528 of Bhartiya Nagarik Suraksha Sanhita (hereinafter referred as 'BNSS') has been preferred against the order dated 06.03.2025, passed by the Special Judge, SC/ST (PA) Act, Bulandshahr, in complaint case No. 55 of 2024, by means of which the complaint filed by the applicant has been dismissed under Section 203 Cr.P.C. 3. It is clear from the provisions of Section 14-A (1) of SC/ST Act that against an order passed by the Special Judge, SC/ST (PA) Act, the applicant has remedy of filing an appeal and thus, the present application under Section 528 BNSS is not maintainable. 4. In view of the aforesaid, the instant application under Section 528 BNSS is dismissed as not maintainable. The applicant would be at liberty to file an appeal or to resort appropriate legal remedy that may be available under the law. 5. Certified copy of the order available on record, if any, be returned to the learned counsel for the applicant after obtaining photocopy of the same on record.
