The present writ petition is filed under Article 226 of the Constitution of India by the petitioner seeking following reliefs:-
“a. Issue an appropriate writ, order, or direction, permitting the petitioner to approach the International Criminal Court (ICC), ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2025.08.02 12:22:08 +0530
2 The Hague, Netherlands, under Article 15 of the Rome Statute, for redressal of grave human rights violations and alleged or grave human rights violations and alleged crimes against humanity committed by public officials of South East Central Railway, Bilaspur, Chhattisgarh; b. Declare that the right to seek international remedies under the doctrine of universal jurisdiction, in the face of conitnued impunity and failure of domestice legal remedies, is implicit under Articles 21 and 14 of the Constitution of India; c. Direct the Union of India, through the Ministry of External Affairs and the Ministry of Law and Justice, to facilitate and not obstruct the petitioner’s communication to the ICC, in accordance with Articles 51(c) and 253 of the Constitution of India; d. Direct the Ministry of Home Affairs and/or the Central Bureau of Investigation (CBI) to register a criminal case against the officials concerned under relevant provisions of the SC/ST (Prevention of Atrocities) Act, 1989, the Prevention of Corruption Act, and applicable provisions of the Bharatiya Nyaya Sanhita, 2023, or other appropriate national and international laws; e. Grant such interim protective directions as this Hon’ble Court, may deem fit for ensuring the personal safety, liberty, and dignity of the petitioner and his family, under Article 21 of the Constitution of India; f. Pass any other or further order(s) as may be deemed just, proper, and necessary in the interests of justice, international accountability, and constitutional protection.”
2. Petitioner in person Mr.
Petitioner in person Mr. Bibhas Das submits that he is a Scheduled Caste citizen of India and a former railway servant under the South East Central Railway (SECR), Bilaspur, and he has been a victim of systemic caste-based persecution, institutional torture, psychological warfare, and illegal dismissal from service by certain public officials. Despite exhausting all domestic legal remedies, including repeated representations to the Hon’ble President of India, the Chief Justice of the Supreme
3 Court and High Court, and the Ministries concerned, no action has been taken except direction was issued by the President's Secretariat of the Hon’ble President of India, and the perpetrators continue to enjoy impunity. He submits that till today no information has been communicated to him. 3. On the other hand, learned counsel for DSGI opposes the reliefs sought by the petitioner-in-person and submits that the present writ petition is baseless and has no such ground upon which it should be entertained. 4. I have heard learned counsel for the respective parties, perused the document available with utmost circumspection. 5. Bare perusal of the present petition as well as the record available, it reveals that the petitioner belongs to Scheduled Castes community and was a former Chief Office Superintendent in the South East Central Railway (SECR), Bilaspur, Chhattisgarh. However, he was dismissed from the service. Being aggrieved of that, he has submitted detailed representations, complaints, and legal petitions before the Hon’ble President of India, the Hon’ble Prime Minister’s Office , the Hon’ble Chief Justice of India, the Hon’ble Chief Justice of the High Court of Chhattisgarh, the Ministry of Railways and other authorities. 6. Looking to the facts and circumstances of the case and the submission made by the learned counsel for the respective parties this Court is of the considered view that the relief sought by the petitioner by way of this petition is baseless and has nothing to be
4 entertained, petitioner has only drafted a vague and sketchy prayer and the same is a defective one. 7. Accordingly, the present petition is dismissed subject to deposition a sum of Rs. 5,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Governemtn School for Visual and Hearing Impaired, Tifra, District-Bilaspur, Chhattisgarh.
