Heard Mr. Bharat Lal Dembra, learned counsel for the appellant as well as Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State; and Mr. J.K. Gupta, learned counsel, appearing for respondent No. 3, on I.A. No. 1 of 2025, which is an application for condonation of delay. 2. Considering the grounds mentioned in I.A. No. 1 of 2025, the application is allowed. Delay of 17 days in filing the appeal is hereby condoned. 3. The present intra-court appeal has been preferred by the appellant against the order dated 09.05.2025 passed by the learned Single Judge in WPC No. 2435 of 2025 (Jasvinder Singh Sawhney vs. Regional Transport Authority & Others), whereby the writ petition filed by respondent No. 3/writ petitioner was disposed off at the motion stage. 4. Learned counsel for the appellant submits that he had filed a caveat and was arrayed as respondent No. 2 in WPC No. 2435 of 2025. However, the said writ petition was disposed off without affording him an opportunity of hearing. He, therefore, prays for withdrawal of the present writ appeal with liberty to avail appropriate legal remedy before the learned Single Judge. 3 5.
