2. Applicant has sought bail in connection with FIR No. 118 of 2019, registered against him under Section 420 IPC and Section 3 of Uttarakhand Protection of Interests of Depositors (In Financial Establishments) Act, 2005, in Police Station, Lal Kuan, District Nainital.
3. It is contended that applicant is in jail since 18.12.2023, thus he has suffered incarceration for more than one year; bail application filed by co- accused Mritiyunjay Sahu, having similar role, was allowed by this Court vide order dated 10.08.2023; applicant was not having the signing authority and the said authority was with Mr. Mritiyunjay Sahu, therefore, this is a fit case for bail.
4. Learned State Counsel submits that there are two more FIRs registered against applicant, one in Police Station Lal Kuan and another in Police Station Mujesar, District Faridabad, thus he opposed the prayer for bail.
5. Since co-accused having similar role has
2025:UHC:49 been granted bail in 1Pst P Bail Application No. 1395 of 2023, therefore, this Court thinks that it is also a fit case for bail.
6. Accordingly, Bail Application is allowed.
7. Let the applicant, namely, Snehasis Bhattacharyya be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned, subject to the following conditions:- (i) The applicant shall surrender his passport before Trial Court, if he has one. In case, he does not possess passport, then he shall file an affidavit to that effect. (ii) Applicant shall not leave the country without prior permission of the Trial Court. (iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case. (iv) Applicant shall appear before the Trial Court, as and when required.
9. It is made clear that any observation made by this Court is only for the purpose of disposal of bail application. It shall not be taken into
consideration at all in any other proceedings. 10. Pending Applications(s), if any, stand disposed of.
