3. The applicant – Vipin Thakur, who is in judicial custody in connection with FIR/ Case Crime No. 334 of 2025, under Sections 109(1), 3(5) of BNS and Section 3 and 25 of Arms Act, registered at P.S.- Sitarganj, District Udham Singh Nagar, has sought his release on bail.
4. Heard learned counsel for the parties and perused the records.

Learned counsel for the applicant submits that that applicant has been falsely implicated in the case; that there were total 14 accused, out of which, all the co-accused have already been granted bail/ anticipatory bail by the courts below or the coordinate bench of this Court.
Learned counsel further submits that it is a case of parity and in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court.
6. Learned State Counsel submits that applicant has a criminal antecedents of 14 cases pending against him, out of which, 5 cases are relating to Section 307 of IPC.
Though, learned State Counsel also admits the fact that all the co-accused have already been enlarged on bail/ anticipatory bail.
7. Be that as it may, no specific role has been assigned to the applicant in the present case. Having considered the submission of learned counsel for the parties and also considering the fact that all the co-accused have already been granted bail/ anticipatory bail, without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage.
8. The bail application is allowed.
9. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
