JUSTICE BISWAJIT PALIT Order 08/01/2025 Learned Senior Counsel, Mr. Subrata Sarkar assisted by Learned Counsel, Ms. Monalisa Pal is present for the accused-in- custody namely Sri Sankar Debnath. Learned P.P., Mr. Raju Datta along with Learned Addl. P.P., Mr. Rajib Saha is present on behalf of the State-respondent. The accused-in-custody namely Sri Sankar Debnath is presently lodging in jail in connection with Jatrapur P.S. case No.2024JTP015 under Section 20(b)(ii)(C)/25/29 of NDPS Act. At this stage, Learned Senior Counsel drawn the attention of the Court that the mother of the accused has expired on 30.12.2024 and the last rites of his deceased mother is fixed tomorrow i.e. on 09.01.2025. So, Learned Senior Counsel urged for passing an order so that the accused may be permitted to attend the last rites of his deceased mother. Learned P.P., Mr. Raju Datta raised no objection but at the same time urged before the Court to pass necessary order to the authority to produce the accused under proper escort. Considered. 2 In this case, trial of the accused is going on. So, considering the facts and circumstances of the situation, the Superintendent, Kendriya Sansodhanagar, Bishalgarh be asked to produce the accused-in-custody namely Sri Sankar Debnath to attend the last rites of his deceased mother under proper escort tomorrow i.e. on 09.01.2025 at his residence and after completion of the rites, the accused be returned back to Kendriya Sansodhanagar, Bishalgarh accordingly under proper care and escort. It is also ordered that the accused may be allowed to leave the Kendriya Sansodhanagar, Bishalgarh in the morning in between 8 am to 9 am and be returned back before sunset. A copy of this order be communicated to the Superintendent, Kendriya Sansodhanagar, Bishalgarh through Learned P.P. for immediate compliance. Also, a copy of this order be communicated to SP, Sepahijala District for providing sufficient escort and security for escorting accused-in-custody from Kendriya Sansodhanagar, Bishalgarh to his residence. A copy of this order be supplied to Learned Senior Counsel for the applicant, Mr. Subrata Sarkar for information in course of the day and also a copy of this order be furnished to Learned P.P. in course of the day for complaince.
