ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in trying to erect the High Tension Electric Poles in the petitioner’s subject property situated in Sy.No.339 of Peddoddi Village Accounts, Gooty Mandal, Ananthapuram District without issuing any proper notice and without following due process of law as illegal, arbitrary, unconstitutional and contrary to the principles of natural justice besides being violative of Article 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to lay down/erect the High Tension Electric Poles In the petitioner’s subject property situated in Sy.No.339 of Peddoddi Village Accounts, Gooty Mandal, Ananthapuram and pass such other order. ”
2. Heard the learned counsel for the petitioner, the learned Standing Counsel for respondent Nos.2 to 4 and the learned Government Pleader for the other respondents.

Learned counsel for the petitioner submits that the petitioner purchased the subject property i.e., an extent of Ac.7.06 cents in survey No.339, 339/1 of Peddoddi Village Accounts, Gooty Mandal, Ananthapuram through four registered sale deeds dated 16.11.2021, 17.11.2021, 30.03.2022 and 30.03.2022. Since then the petitioner has been in peaceful possession and enjoyment of the subject property. The name of the petitioner was mutated in the
3 revenue records and pattadar passbook and title deed were also issued in favour of the petitioner.

Learned counsel for the petitioner further submits that the petitioner has also donated approximately Ac. 1.00 cents of subject property to the village to safeguard the natural watercourse stream flowing through the subject property and also for using as pathway to the villagers. While so, the 5^^ respondent issued an
order dated 17.12.2024 by granting permission for installation of overhead transmission lines between Ananthapuram and Kurnool. In view of the same, the respondents intend to erect the High Tension Electric Poles at the petitioner’s subject property. The petitioner approached the respondents and informed that erection of High Tension Electric Poles in the subject property will adversely affect the farming operations. But the respondents did not consider the request of the petitioner and proceeding further for erection of the High Tension Electric Poles. He further submits that already 11 KVA electric line passing through the subject property and if the respondents are allowed to erect another High Tension Electric Poles, the way to approach the adjacent land of the petitioner will be permanently closed. Hence, the present Writ Petition.
5. Learned Standing Counsel for respondent Nos.2 to 4 submits that the respondents will consider the request made by the petitioner, by following due process of law.

6. Having regard to the
submissions made by both the
learned counsel and on perusal of the material placed on record, this Court is of the considered opinion that the present Writ Petition can be disposed of directing the respondents not to lay/erect the High Tension Electric Poles in the petitioner’s subject property without following due process of law.
7. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed.
