The present writ appeal has been filed with the following prayer:- “It is therefore, prayed that the Hon'ble Division Bench may kindly be pleased to allow this writ appeal and to set aside the order passed by the Hon'ble Single Judge on 09.05.2025 and the learned single judge is directed to decide the matter on merits after giving due opportunity of hearing to the appellant in the interest of justice or any order as this Hon'ble Court may deems fit may be passed in favour of the appellant.” 3. Learned counsel for the appellant submits that he has filed caveat and was party (respondent No. 2) before the learned Single Judge in the WPC No. 2432 of 2025. But the said writ petition was disposed off at motion stage without hearing the appellant/ 3 respondent No. 2. He further prays for withdrawal of the present writ appeal with liberty to take recourse to law as may be available to him before the learned Single Judge. 4.
