The present application is filed under sections 482 of Bharatiya Nagarik` Suraksha Sanhita seeking to enlarge the Petitioners/Accused on bail in the event of their arrest in connection with Cr.No.272 of 2024 of Chilakalurl'peta Town Police Station, Palnadu. The Crime was registered for the offences under sectI'OnS 61(2),196 (1), 352, 353(1) read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 3. As per the complaint, on 29.ll.2024, the Accused No.1 through the Facebook page named sai Kaarthikeya City Center, allegedly posted abusive content targetI'ng the local MLA and his family members with the help and suggestions of Accused Nos.2 to 5. 4. Learned counsel for the petitioners submits that the allegations made are false and the petitioners dl'd not make any derogatory post as alleged and that the petitioners can be released on bail. 5. Learned Assl®stant Public Prosecutor submitted that investigation is not yet completed and charge sheet is yet to be filed Ejl and as for all the offences the maximum sentence is less than seven (7) years, the Petitioners would be issued notice under Section 35 (b) of the Bharatiya Nagarik Suraksha Sanhita. 6 6. Taking into consideration that maximum sentence in the case against Petitioners is less than seven (7) years, the mandatory notice under Section 35(b) of the Bharatiya Nagarik Suraksha Sanhita shall be issued to the Petitioners. 7. With the above observations, the Criminal Petition is disposed of. Consequently, miscellaneous applications, if any, pending shall stand closed.
